一名中国男子诈骗苹果公司1500部iphone手机

俄勒冈州塞勒姆(美联社)——在两年的时间里，俄勒冈州的一名中国人向苹果公司寄送了iphone高仿手机，他说这些设备在保修期内开不了机，需要换新。他不是偶尔为之，而是通过亲自前往苹果门店或邮寄的方式向苹果公司提交了大约3000部。

假冒iphone和其他高科技产品的存在已经成为全球二手市场的一个问题，一些假冒产品操作顺畅，用户很难分辨它们和正品之间的区别。但在俄勒冈州的这起案件中，数千部仿冒手机的制造商显然连操作系统都懒得装。

美国国土安全部调查特别探员汤姆斯杜菲在一份法庭文件中援引苹果一位官员的话说，蒋利用了一个漏洞。

“提交一部无法开机的iPhone是质保诈骗的关键，苹果公司技术人员无法马上检查出iPhone的问题或进行维修，苹果手机只能启动换新程序作为其产品保修政策的一部分。”达菲引用了苹果品牌保护代表艾德里安的话。

美国波特兰检察官办公室表示，蒋从香港进口这些假冒产品，并以多个假名提交给苹果。蒋将收到的真手机销售到中国。蒋的同伙将钱支付给住在中国的蒋母，蒋母将钱存入蒋的银行账户。

据法院文件显示，从2016年1月1日到2018年2月1日，蒋收到了来自香港同伙的20到30个假冒iphone的包裹。

早在2017年6月30日，苹果公司就意识到出了问题。当时，苹果公司的法律顾问给蒋发了一封“停止终止服务”的信函，寄送地址是科尔瓦利斯，该地址申报过150起保修索赔。根据达菲的文书，律师们表示，公司知道他进口了假冒苹果手机。蒋没有回复，所以苹果的律师又发了第二封信。

苹果没有立即回应置评请求。

达菲说，苹果拒绝了与蒋有关的1576项保修要求。达菲称，苹果通过了1493起换新索赔，使得这家总部位于加州库比蒂诺的公司遭受了89.5万美元的损失。

美国国土安全部驻西雅图调查办公室主任布拉德·斯特在一份声明中说，走私假冒商品损害了经济和合法经营的企业，并直接影响到消费者。

8月28日，蒋面临最高10年监禁，罚款200万美元或两倍于他非法所得的金额，择高处理。根据认罪协议，美国检察官办公室将建议判处蒋三年监禁，至少赔偿20万美元。

He was doing something called “Express replacement” which is a service for people with the extended warranty plan. Apple would send him the new phone before getting the counterfeit one. He did this numerous times using numerous phones and assumed names.

1500 phones is not that many considering how many are sent to multiple technicians. it is common practice for the tech companies to just throw them out considering it costs more to repair sometimes than to just replace with new. it probably costs apple $10 to build. the counterfit phones were probably built in the same place as the real ones, a couple hundred a week would probably go unnoticed among the millions produced every month.

For anyone wondering how Apple didn’t notice for two years...they probably didn’t notice because back in 2017 Apple was reportedly earning $127 million per day. Given the increase in phone prices, I’m sure that figure has gone up. This wasn’t even a speed bump for them. This suit/complaint was merely to make an example of this guy so that other people wouldn’t mimick his actions.
