一、王某5等与王某6继承纠纷再审案

【裁判摘要】
遗嘱的形式包括公证、自书、代书、录音、口头等多种形式，根据相关规定，被继承人可以按照自己的具体情况，选择其中一种形式设立遗嘱。不过，在司法实践中，被继承人采用上述两种或两种以上的形式设立多份遗嘱的情况也时有发生，此时法院一般会认定被继承人的遗嘱存在形式瑕疵，但是如果多份遗嘱的内容能够相互印证并能表明被继承人的真实意思表示，也没有损害其他人的合法利益时，则法院仍会认定其为有效遗嘱，并遵照遗嘱内容分割遗产。
[Judgment Abstract]
A testament has notarial, holograph, allograph, verbal, and other multiple forms. According to relevant provisions, the decedent may choose one of the forms to make a testament in light of their own specific requirement. However, in judicial practices, there exist occasions where the decedent makes several testaments in two or more of the forms, and in such occasions, a people's court will tend to rule the testaments of the decedent exhibit flaws in their forms.If, however, the content in the testaments is mutually substantiated and shows the genuine expression of will of the decedent, without harming others' lawful rights and interests, the people's court should still rule the testaments as valid, and the decedent's estate should be distributed as per the testaments.

【裁判摘要】
继承人有权继承的是被继承人在死亡时所遗留的个人的合法财产。具体而言，继承人对被继承人死亡时合法所有的房屋享有继承的权利，但作为遗产的房屋在被拆迁后获得的拆迁安置补偿房并不属于被继承人的遗产，当事人无权对该房屋主张权利。此时当事人享有的权利是对拆迁房屋的补偿金请求分配的权利，即析产纠纷，故当事人对拆迁安置补偿房主张继承权的法院不予支持。
[Judgment Abstract]
It is the legal individual property of the decedent that can be inherited by his successors after his death. To wit, whereas the successors have the right to inherit the house legally owned by the decedent, they have no right of succession over the house of compensation for demolition and relocation, which is not part of the decedent’s legacy, notwithstanding the demolished house nominated as a legacy.For this reason, the parties involved are entitled to claim a share of compensation for house demolition, which pertains to a dispute over property partition, while their claim for inheritance of the house of compensation for demolition and relocation will not be supported by the people’s court.

三、贺安银与贺国才、李钰琪赡养费纠纷案
He Anyin and He Guocai v. Li Yuqi (case regarding alimony dispute)
【裁判摘要】
父母因个人原因，将亲生子女送给他人合法收养，双方之间的权利义务已终止。但从实际看，父母和子女之间存在血缘关系，并在一定期间共同生活。在共同生活期间，父母也履行了自己的抚养义务。因此，在父母生活困难的情况下，子女应当在经济承受能力范围内，承担自己的赡养义务。
[Judgment Abstract]
Where parents legally place out their biological child for adoption for personal reasons, the rights and obligations between the adopted child and his or her biological parents have been terminated.But in reality, a blood relationship still exists between the parents and the child, and they have lived together for a certain period, during which the parents have performed their obligations to raise the child. Therefore,the adopted child should, within the scope of his financial capacity, fulfill his duties to support his or her biological parents in financial hardship.
