Brief Introduction/期刊简介
Tsinghua China Law Review (“TCLR”), ISSN: 2151-8904, is the first student-run, English-language journal of legal scholarship published by a Chinese university. Established in 2008, the TCLR is dedicated to advancing the global academic discussion of all issues relating to China law. Over the past decade, we published carefully selected scholarly articles and notes biannually in the United States. These articles are included in renowned databases including HeinOnline, LexisNexis, Westlaw, Vlex and Chinalawinfo. Since 2016, the TCLR has been indexed by ESCI. In 2017, the impact factor and journal cites of the TCLR ranked 1st among English law journals in China and 9th among English journals in the field of Asian Law (source: 2017 Washington & Lee Law Journal Rankings).
《清华中国法律评论》(ISSN: 2151-8904)是中国大陆首家由高校出版、学生自主运作的全英文法律学术期刊。自2008年创刊以来,本刊一直致力于在全球层面促进有关中国法律问题的学术研讨。在过去十年间,本刊每年在美国出版两期精心挑选的学术文章和评注,并被HeinOnline、LexisNexis、Westlaw、Vlex和北大法宝等著名数据库收录。本刊自2016年起被ESCI收录。2017年,本刊影响因子数量与被引数量在中国大陆英文法学期刊中排名第一,在亚洲法领域英文法学期刊中排名第九(数据来源:2017年Washington & Lee法学期刊排名)。
Background/征文背景
We are currently witnessing a profound technological revolution, driven by advancements in generative artificial intelligence (GenAI), big data analytics, blockchain, and biotechnology. This new wave of technology is not merely an incremental change; it is a paradigm shift that fundamentally challenges existing legal frameworks. It questions established concepts of liability, property, due process, and sovereignty. The “black box” nature of complex algorithms creates unprecedented problems for accountability, while the borderless flow of data tests the territorial limits of national jurisdiction.
我们正身处一场深刻的技术革命,其驱动力来自生成式人工智能(GenAI)、大数据分析、区块链和生物技术。这场新技术浪潮不只是渐进式的变革,更是一场范式转移,它从根本上挑战了现有的法律框架,对法律责任、财产权、正当程序和国家主权等既有概念提出了质疑。复杂算法的“黑箱”特性给问责带来了前所未有的难题,而数据的无界流动则在不断试探国家属地管辖权的边界。
China, standing at the global forefront of both technological development and regulatory experimentation, provides a critical and unique case study. The Chinese legal system is grappling with these challenges in real-time, navigating a complex path between fostering state-led technological innovation and the urgent need for social governance and the protection of fundamental rights. The rapid promulgation of legislation concerning personal information protection, data security, and generative AI reflects a distinct “agile governance” approach. However, this dynamic landscape raises profound questions: How can law, which relies on stability, effectively regulate technologies defined by exponential change? How does China’s vision for “data sovereignty” and its regulatory framework interact with, and perhaps reshape, global norms of digital trade and internet governance? We particularly welcome submissions that place China’s experience in a comparative context or analyze its outward-facing impact, appealing to both Chinese law specialists and international/comparative law researchers.
中国正处于技术发展和监管实验的全球前沿,为世界提供了一个至关重要且独特的案例。中国法律体系正在实时应对这些挑战,在“促进国家主导的科技创新”与“实现社会治理和保障基本权利的迫切需求”之间开辟一条复杂的路径。中国在个人信息保护、数据安全和生成式人工智能等领域的快速立法,反映了一种独特的“敏捷治理”模式。然而,这种动态的图景也引出了更深层次的问题:依赖稳定性的法律,如何才能有效规制日新月异的技术?中国的“数据主权”愿景及其监管框架,将如何与全球数字贸易和互联网治理的规范互动,甚至重塑这些规范?我们尤其欢迎将中国的经验置于比较法背景下,或分析其全球性影响的稿件,以期吸引中国法学者和国际法/比较法学者的共同关注。
To explore these critical issues, Tsinghua China Law Review is launching this special issue. This call for submissions is also a paper competition. We will organize an expert committee to review the submissions. Outstanding papers will be selected and given priority for publication in TCLR. We are also honored to have the academic guidance of the Asia Pacific Law Review for this event.
为深入探讨这些关键问题,《清华中国法律评论》特此发起本专题征稿。本次征稿亦是一次征文比赛。我们将组织专家委员会对来稿进行评比,评选出的优秀论文将择优在本刊发表。此外,我们很荣幸地邀请到《亚太法律评论》(Asia Pacific Law Review)为本次活动提供学术指导。

We call for papers on this topic. We are interested in submissions that move beyond doctrinal description to offer critical analysis of the foundational challenges. The following sub-topics can be chosen (but not limited to):

1. Foundational Theory & Governance / 基础理论与治理
Foundational Theories: The adaptability of traditional legal principles (e.g., liability, property, personhood) in the age of AI and big data.
Constitutional & Administrative Law: The balance between digital surveillance, algorithmic governance, and fundamental rights (e.g., privacy, due process, non-discrimination).
Emerging Frontiers: Legal and ethical governance of biotechnology (e.g., gene editing).

Economic Law: The regulation of “gatekeeper” platforms, algorithmic collusion, and the application of anti-monopoly law in data-driven markets.
Environmental Law: The role of technology in environmental governance (e.g., “smart surveillance”), climate change mitigation, and regulating the environmental footprint of the tech industry (e.g., energy consumption of data centers).
Emerging Frontiers: Legal and ethical governance of FinTech (e.g., cryptocurrency, DeFi).
经济法: “守门人”平台的规制、算法合谋、反垄断法在数据驱动型市场中的适用。
环境法:技术在环境治理(如“智慧监测” )、缓解气候变化中的作用,以及对科技产业自身环境足迹(如数据中心能耗)的规制。

3. Rights & Accountability / 权利与归责
Private Law: Allocating liability for autonomous systems, the legal status of data and virtual assets, and algorithmic bias in contracts or torts.
Criminal Law: Combating new forms of cybercrime, the use of AI in law enforcement, and the legal challenges of deepfakes and disinformation.
私法:自主系统的责任分配、数据和虚拟财产的法律地位、合同或侵权中的算法歧视。
刑法:打击新型网络犯罪、人工智能在执法中的应用、深度伪造和虚假信息的法律挑战。
4. International & Comparative Dimensions / 国际与比较维度
International Law: The implications of China’s data governance regime (e.g., PIPL, DSL) for international trade rules (e.g., WTO) and cross-border data flows.
Comparative Law: Comparative studies on regulatory approaches to new technologies (e.g., AI governance models in China, the EU, and the US).
国际法:中国的数据治理机制(如个人信息保护法、数字安全法)对国际贸易规则(如WTO)和跨境数据流动的影响。
比较法:新技术监管路径的比较研究(如中国、欧盟、美国的AI治理模式对比)。

Competition, Review Process, and Awards / 比赛、评审与奖项
To enhance the visibility and quality of the special issue, this call for submissions is run as a competition. Submissions will be evaluated based on originality, analytical rigor, academic contribution, and relevance to the theme. An honorary review committee will participate in the judging process. This committee will be composed of internationally recognized scholars, including Professor Julien Chaisse (Editor-in-Chief, Asia Pacific Law Review (SSCI)) and other leading experts from China, the United States, India, and other regions. We are also honored that Professor Chaisse will contribute the Preface for this special issue. The authors of the top three papers and honorable mentions will receive special recognition and a modest publication award. Furthermore, selected authors will be invited to present their work at a dedicated TCLR Symposium, offering an opportunity for in-depth discussion with reviewers and the editorial board.
为提升本特刊的学术可见度与质量,本次征稿将以征文比赛的形式进行。稿件将基于其原创性、分析严谨性、学术贡献度以及主题相关性进行评审。我们将组建一个由国际知名学者组成的荣誉评审委员会参与评审工作。该委员会将包括《亚太法律评论》(SSCI)主编Julien Chaisse教授,以及来自中国、美国、印度等地区的其他领军专家。我们也很荣幸地宣布,Chaisse教授将为本特刊撰写序言(Preface)。排名前三的论文及优秀奖(honorable mentions)的作者将获得特别表彰和一定的出版奖励。此外,部分优秀论文作者将被邀请参加TCLR专题研讨会,与评委和编辑委员会进行深入交流。
