近日,一河北网友发帖称,“大意了,这也太像中石化了”!该网友回忆,当时还在纳闷为何油价如此便宜,然而工作人员表示,他们不是中国石化,而是中园石化。

The issue trended on social media on Tuesday after a netizen said they had mistaken "Zhongyuan Petrochemical" for a well-known national chain due to its similar branding, only to later discover it was unrelated.

该网友发布的图片显示,中园石化”为红底白字,和同为红底白字的中国石化只有一字之差,英文“SNOPEC”只是少了一个字母“I”

Images circulating online show the station using a red-and-white color scheme nearly identical to that of its better-known counterpart, with the English name "SNOPEC" differing from "SINOPEC" by just one missing letter.

该涉事加油站相关人员回应称,加油站已经营十多年,一直使用该名字,且已通过了审批。

Staff said the station has operated under the name for over a decade and has obtained the necessary approvals.

对此,有不少网友质疑,“中园石化”这类名称,存在碰瓷嫌疑。

据极目新闻,记者查询天眼查发现,该加油站为石家庄市鹿泉区中园石化百尺杆加油站,曾用名为鹿泉市中园石化加油站。

鹿泉区市场监督管理局工作人员回应,仅凭站名还不好判定,是否侵权还要根据装修情况来综合判定,他们将派人现场调查。

Local regulators said the name alone is insufficient to determine whether infringement has occurred, adding that an on-site assessment of the station's overall design and presentation is required.

这样的情况并非个例。据此前报道,江苏扬州仪征市一加油站曾因侵犯中国石化注册商标专用权,被行政处罚10000元。该站所用的标识与中国石化官方logo近似,容易造成消费者混淆和误认,损害了消费者的利益。

律师:可能构成商标侵权与不正当竞争

北京德和衡律师事务所副总裁、高级权益合伙人陈燕红告诉中青报·中青网记者,从法律层面分析,该行为有可能构成商标侵权与不正当竞争。

依据《中华人民共和国商标法》第五十七条第二项规定,未经商标注册人许可,在同一种商品或服务上使用与其注册商标近似的商标,容易导致混淆的,属于侵犯注册商标专用权。中国石化对“中国石化”“SINOPEC” 及相关组合标识享有合法注册商标专用权,核定使用于成品油零售服务,该商标经长期使用已具备极高市场知名度与显著性。

Legal experts said the case may involve violations of China's Trademark Law and Anti-Unfair Competition Law, noting that the use of similar marks in the same sector in a way that causes confusion can constitute infringement.

“中园石化” 在相同的成品油零售服务中,将 “中园石化”“SNOPEC” 及近似红底白字装潢用于招牌、灯箱等商业标识,属于商标性使用;其名称与 “中国石化” 仅一字之差、字形读音高度近似,英文标识 “SNOPEC” 与 “SINOPEC” 仅少一个字母 “I”,整体视觉与读音均可能造成消费者混淆,存在被认定为商标侵权的可能

其次,“中园石化” 的行为还可能构成不正当竞争。“中园石化” 通过刻意模仿 “中国石化” 的名称、英文标识、招牌配色与整体布局,若主观上具有明显攀附他人商誉、“搭便车” 的恶意,客观上足以使普通消费者产生误认并可能扰乱了公平竞争的市场秩序,还可能依法应认定为不正当竞争行为

They added that the established brand holds registered rights over its names and visual identity, and that imitation which misleads consumers could also amount to unfair competition if intended to benefit from its reputation.
