最近,一款叫作同事.skill的开源项目在GitHub上线并迅速走红,只需导入同事的职场数据作为素材,就能通过AI生成可替代同事工作的AI技能。换言之,给AI智能体装上这个技能,就能创造出跟同事拥有相同工作逻辑思维,乃至说话方式都相似的“数字同事”。

A project called colleague.skill was recently published on GitHub, and quickly went viral. It promises to convert workplace data into digital versions of employees capable of replacing them on the job. In other words, equipping an AI agent with this capability will make it possible to create a "digital colleague" that shares the work logic and mindset of the human coworker, and even speaks in a similar way.

同事.skill也引发了关于职业安全感、技术伦理、隐私和人格权的激烈讨论。

After going viral, the project ignited discussions about job security, technological ethics, privacy and personality rights.

小红书上,有网友晒出数字前同事的消息:“我是已离职员工XX的数字分身。你可以向我提问,我会根据我在职期间的相关记录为你解答。”

On social media platform Xiaohongshu, one user posted greetings from a digital former colleague: "I'm the digital avatar of the former employee. You may ask me questions, and I will answer based on documents from my time working here."

另一位网友则表示公司让员工用自己的技能训练AI。

法律专家提醒,这类做法风险极大。

Legal experts warn that such practices carry significant risks.

北京市盈科律师事务所律师孟泽东表示,未经他人同意,就抓取其工作沟通记录、邮件和文档等行为属于滥用个人信息

Meng Zedong, a lawyer at Yingke Law Firm in Beijing, said collecting an individual’s work records, emails and documents without consent constitutes an abuse of personal information.

他说:“一般如设计图纸、技术方案以及在职期间为完成任务创作的职务作品等属于公司的知识产权,而逻辑思维、沟通习惯以及工作经验等属于员工的个人隐私。公司无权在员工不知情下,用其技能训练AI。”

"Intellectual property such as design drawings and technical plans created during employment belongs to the company," he said. "However, logical thinking, communication habits and work experience are part of personal privacy. Companies have no right to use such data to train AI without the individual's knowledge."

如果AI模型能识别出具体某个人,这同样可能侵犯其人格权。“我国法律明确规定公民人格尊严不受侵犯,这种行为涉嫌侵害人格尊严且违背公序良俗。”他说。

If an AI model can identify a specific person, it may also infringe on personality rights, he added. "Chinese law stipulates that personal dignity is inviolable. Such acts may violate that principle and contravene public order and good morals," he said.

中央财经大学法学院教授王叶刚认为,抓取个人的职场数据生成数字分身,可能构成对个人相关民事权益的侵害

Wang Yegang, a law professor at the Central University of Finance and Economics, said creating digital replicas using personal data could infringe multiple civil rights.

他说,如果数字人使用真人的名字、声音、身份,可能会侵犯其人格权。如果该数字人发表不当言论,造成被抓取个人信息的特定个人社会评价降低的,还构成对其名誉权的侵害。

If a replica uses a person's name, voice or identity, it may violate personality rights. If it makes inappropriate remarks that harm the individual’s reputation, it could constitute defamation, he said.

公司也无权要求员工用自己的技能训练AI,因为其通常并不构成为人力资源管理所必需的情形。

He added that companies generally cannot require employees to train AI systems with their own skills, as this does not qualify as a necessary component of labor management.

“如果员工发现自己被复制,则个人有权依法请求行为人删除数据、销毁模型、赔礼道歉,并可以依法主张财产损害赔偿和精神损害赔偿。”他说。

"Individuals who find themselves replicated have the right to request deletion of data, destruction of models and an apology," Wang said. "They may also seek compensation for property damage and emotional distress."

智联招聘副总裁李强表示,企业尝试这类工具的初衷,往往是为了把员工头脑中的隐性经验转化为组织可以沉淀的显性资产,从而降低关键人才流动可能带来的业务断层风险。他同时理解,这种做法也会让在职员工产生一定的不安。

Li Qiang, vice-president of recruitment platform Zhaopin, said some companies are using such tools to transform employees' experience into organizational assets and reduce disruption when staff members leave. He understands that such practices may cause unease among employees.

在他看来,短期内“同事.skill”并不会直接导致裁员。因为目前通过数据蒸馏出来的AI只能处理高度结构化的标准化任务,而复杂判断、人际协调、临场应变等场景,还远远替代不了人的作用。

Li said the technology is unlikely to trigger layoffs in the short term, as AI models derived from employee data can only handle structured, routine tasks and cannot replace humans in complex decision-making, interpersonal coordination, or problem solving.

李强也提醒,如果企业过度依赖这种“蒸馏”出的技能包,反而可能削弱团队的创新活力。“AI擅长复刻过去的经验,但面对从未见过的新问题,仍然需要人的判断和突破。”

He cautioned, however, that over-reliance on such systems could weaken innovation. "AI is good at replicating past experience, but human judgment is still essential when confronting new problems," he said.

他最后谈到,焦虑是正常的,但不必恐慌。每一次技术变革,其实都在重新定义“人的价值”。而这一次,AI反而帮我们看清了:哪些能力才是人类特有的。

Li added that anxiety is normal, but there is no need to panic. "Every technological revolution redefines human value," he said. "This time, AI may help us better understand which abilities are truly unique to human beings."
