近日,不少网友反映,曾在张静初直播间购买 “优思益” 相关产品,如今不仅迟迟未收到退款,还陷入退货无门的困境。
Chinese actress Zhang Jingchu is facing growing backlash after consumers who purchased "YouthIt" products through her livestream said they were unable to obtain refunds or return the items.
对此,张静初在最新发布的视频中作出回应,称自己刚从秘鲁旅行回来,已看到网友关于“优思益”的相关评论,明确表示当前问题的解决方式仍需通过平台售后和客服统一处理,同时表达了对网友情绪的理解,并承诺后续会持续关注此事,感谢网友的理解与支持。
然而,张静初的回应并未平息网友的不满。不少网友表示,平台售后渠道早已走不通,消费者在平台与相关方之间被来回推诿。
In a recent video, Zhang said she had seen the complaints and that the matter should still be handled through the platform's after-sales and customer service channels.
Her response, however, did little to ease public anger, with many buyers saying those channels have been ineffective and left them without a clear solution.
律师:不存在“不知情免责”
对此,北京市高朋(南京)律师事务所合伙人陈凯律师认为,明星主播的法律责任不存在“不知情免责”。明星在直播间以推荐、证明等形式带货,本质上属于广告法上的广告代言行为。不论明星是否明知品牌造假,均须与广告主共同承担赔偿责任。
Legal experts say celebrities cannot avoid liability by claiming ignorance. Chen Kai, a lawyer at Gaopeng & Partners, said livestream endorsements are legally treated as advertisement, meaning endorsers may share responsibility with the brand.
另外,“推给平台”并不能切割张静初的法定责任。张静初将消费者引向“平台客服”,试图将责任转嫁给电商平台,这在法律上并不构成有效的责任切割。事实上,在优思益品牌方已陷入“无力售后”的困境下,让消费者自行与平台周旋,实质上是将维权成本转嫁给了消费者。
He added that directing consumers to platform customer service does not remove that responsibility and may instead shift the burden onto buyers when after-sales support breaks down.
购买了“优思益”的消费者应如何维权呢?
律师表示,结合当前事件进展及媒体披露信息,生产者和经营者或涉嫌欺诈,消费者有权向其主张“退一赔三”。同时,鉴于曝光产品存在虚假标注产地的情况,律师认为,这也属于重大安全隐患,消费者可以依据《食品安全法》寻求10倍赔偿。消费者可从以下三个路径进行维权:
① 证据固定与收集:消费者需保留订单截图、支付记录、物流信息等;同时,截图保存产品页面、直播视频、广告文案等虚假宣传内容;另外,保留与商家、平台客服的对话记录(如平台敷衍退款、拒绝赔偿等情况)。
Affected consumers can seek compensation by preserving evidence such as order records, payment receipts, product listings and communications with sellers or platforms.
② 投诉与举报:消费者可通过12315平台或向当地市场监管局举报,要求立案调查并处罚涉事企业;还可向税务部门及公安机关报案。
They may also file complaints through China's 12315 consumer hotline or report the case to market regulators or police.
③ 诉讼与集体维权:消费者可依据《民事诉讼法》向法院起诉,主张退货退款及三倍赔偿。若受害者众多,可依据《消费者权益保护法》第47条,由省级消协提起公益诉讼,以降低个体维权成本。若担心企业转移资产,可向法院申请冻结涉事公司账户或等值财产。
Legal action remains another option. Consumers can seek refunds and triple compensation, while consumer associations may pursue public interest litigation in large-scale cases. Courts can also freeze company assets to prevent transfers.

Earlier reports found that the "Australian YouthIt" brand had fabricated its overseas origin, with its claimed Melbourne factory allegedly being an auto repair shop while the products were made domestically. The items have since been removed from major e-commerce platforms, and several celebrities have issued public apologies.
据国家市场监督管理总局4月1日公告,针对媒体报道的跨境电商进口“优思益”保健品涉嫌原产地造假、虚假宣传等问题,国务院食安办、市场监管总局、海关总署高度重视,立即组织涉事地市场监管部门和海关开展调查核实,严查违法违规行为,切实维护市场秩序,保护消费者合法权益。
