近日,澳门治安警侦破一宗非法工作案件,两名持旅客身份入境的内地学生,因在澳门开展有偿旅拍服务、非法雇佣涉事人员被查获。

Two mainland students who were visiting the Macao Special Administrative Region as tourists have been caught in an illegal employment case involving paid travel photography.

据悉,10月1日傍晚,澳门特区政府治安警警员在路氹连贯公路巡查时,发现两名女子正在拍摄并进行现金交易,疑似存在非法工作嫌疑,随即上前截查。

经调查,20岁的内地女学生张某,通过社交平台联系到21岁的内地女子张某,以400元人民币时薪聘请对方到澳门,为自己及友人提供旅拍服务,二人事前互不相识。警方现场检获1部相机、3部手提电话等涉案证物。

The inquiry found that a 20-year-old mainland female student surnamed Zhang had contacted another mainland female student, aged 21 and also surnamed Zhang, through a social-media platform.
The younger Zhang allegedly hired the 21-year-old Zhang she contacted at 400 yuan per hour to come to Macao and provide travel-photography services for her and her friends. The two had never met before. Police seized a camera and three mobile phones at the scene on Oct 1.

目前,案件已进入后续处置流程。出资雇人的张某涉嫌触犯澳门特区“不合规范的雇用罪”,被警方立案移送检察院;提供拍摄服务的张某持旅游签注在澳从事有偿劳务,违反澳门特区《聘用外地雇员法》,已移交澳门劳工局跟进处理。

The 20-year-old hirer has been transferred to the Public Prosecutions Office on suspicion of unlawful hiring, an offence under local Macao law. The 21-year-old photographer, who was in Macao on a tourist endorsement, has been referred to the Labour Affairs Bureau for allegedly engaging in paid work.

据澳门警方披露,今年6月也曾查处同类案件,一名内地女子花费1098元人民币聘请内地男子赴港澳旅拍,在澳门被当场查获,此类跨境非法旅拍案件呈多发态势。

针对旅拍行业乱象,澳门特区政府计划修订《特定业务及活动的规管制度》,将旅游景点有偿流动拍摄服务纳入监管,填补现有法律空白。新规拟简化准入机制,将繁复的准照制度改为登记制,明确仅限澳门居民登记从业,率先规范大三巴、议事亭前地等热门打卡景点的旅拍行为。

This case is the latest in a series of cross-border illegal travel-photography cases. In response, the Macao SAR government plans to amend the regulatory system for specific businesses and activities, which would bring paid mobile photography at tourist attractions under official supervision.
The proposed rules would simplify access by replacing the current licensing system with registration and would make only Macao residents eligible to register as providers of such services. Popular photo spots such as the Ruins of St. Paul's and Senado Square would be among the first areas regulated.
