近期，市场上出现一本名为《勇敢追梦人：张雪的极致热爱与逆袭人生》的图书。
A recently published book titled Brave Dream Chasers has become the center of a legal controversy, as the subject of the book, renowned motorcycle racer Zhang Xue, denies any authorization.
5月24日，抖音账号“张雪机车”发布声明称，张雪先生本人从未授权张小平、北京联合出版有限公司编著、出版、发行该书。该书擅自盗用张雪先生姓名、个人经历及隐私信息已构成严重侵权。
On Sunday, the Douyin account "ZXMOTO" issued a statement declaring that Zhang had never authorized Zhang Xiaoping or Beijing United Publishing Co Ltd to compile, publish, or distribute the book. The statement accused the publisher of serious infringement by misappropriating Zhang's name, personal experiences, and private information without permission.
张雪先生已委托律师发函，要求侵权方立即下架、召回、销毁所有图书，并公开致歉赔偿。截至目前，侵权方仍继续发行销售该书。后续将依法追究侵权方全部法律责任。
Legal counsel representing Zhang has sent a formal cease-and-desist letter demanding the immediate removal, recall, and destruction of all copies, along with a public apology and compensation. According to the statement, the infringing parties have continued to sell the book despite the notice. Zhang's team has vowed to pursue full legal liability.
同日，张雪本人也在其个人账号“张雪的机车”发布视频声明此事：“在我们夺冠以后，其实有很多出版社邀请我们出书，所有的要求我们都拒绝了，其实我们觉得自己还不够格。但是我有同事在网上看到有出类似的书，这个我声明，和我本人是无关的。我们同事也发了律师函，对方不回复。我和同事沟通，如果有胜诉的可能，我们就直接起诉，如果产生赔付，我们就用这笔赔付做公益。”
On the same day, Zhang Xue personally addressed the matter in a video posted to his personal Douyin account. "After our championship win, many publishers invited us to publish a book, but we turned them all down. We felt we weren't qualified yet," he said. "Then my colleagues saw a similar book online. I want to make it clear that this has nothing to do with me. We sent a lawyer's letter, but the other side hasn't responded. I've told my team that if we have a good chance of winning, we'll go straight to court. If we get any compensation, we'll donate it to charity."

北京德和衡律师事务所高级权益合伙人陈燕红告诉中青报·中青网记者，结合相关司法解释，书籍《勇敢追梦人：张雪的极致热爱与逆袭人生》未经授权出版发行的行为，存在侵犯张雪姓名权、肖像权、隐私权、著作权、名誉权等民事权利的可能性。
该书以“张雪”姓名作为核心标识，用于书籍标题与内容主线，可能构成民法典第1014 条规定的“盗用他人姓名”行为的情形。若书籍中使用张雪肖像（含比赛照片、个人形象等），且未获得其同意，则可能违反民法典关于肖像权的规定。
若书籍包含“未公开的生活细节、私人决策等隐私信息”，则可能侵犯张雪的隐私权。张雪在社交平台发布的言论、公开演讲内容等，若具有独创性，则可能构成著作权法意义上的“作品”的情形。
若书籍在基于真实信息的情况下，对张雪的评价超出合理范围，或存在误导性表述，可能导致公众对其产生负面认知，仍存在侵害名誉权的风险，尤其在张雪明确拒绝出版个人传记的情况下，此类评价可能违背其个人意愿。
