9月22日出版的《检察日报》第4版披露了一起行为人因高空抛物罪获刑的案例。
A Shenzhen court on Aug 10 sentenced a man to six months in prison and fined him 5,000 yuan for injuring a pedestrian by throwing an object from a high-rise building.
江某在广东深圳务工，与同乡一起租住于深圳前海蛇口自贸区的一处高层住宅。5月8日中午，江某和同乡在家吃完饭收拾碗筷时，为图省事，随手将吃剩的猪排骨从17楼阳台向外抛下。该楼层距离地面约50米，楼下正是人行道。
The man surnamed Jiang rented an apartment with a fellow resident of his hometown in the Qianhai and Shekou area of the China (Guangdong) Pilot Free Trade Zone in Shenzhen. Around noon on May 8, while clearing the table after lunch, he tossed a leftover pork rib from the balcony of his 17th-floor apartment, reportedly to save himself the trouble of disposing of it properly.
彼时，李女士和朋友正途经此处，飞速坠落的猪骨头一下砸中李女士的头部。李女士当即被砸得头晕发蒙，捂着头蹲坐在地，头部血流不止。同行友人立即报警，民警赶赴现场提取到涉案猪骨头，并呼叫120急救。
李女士随即被送往医院救治。经检查，李女士头部右后方形成一处长约2厘米、深约1厘米的创口。司法鉴定显示，李女士损伤程度为轻微伤。
A woman surnamed Li was passing by with a friend when the falling pork bone struck her on the head, causing heavy bleeding. She was taken to hospital, where doctors found a wound about 2 centimeters long and 1 centimeter deep on the back right side of her head. A judicial appraisal later classified the injury as minor.
而江某抛完猪骨头后，将碗筷收拾干净便外出上班了，并未留意到楼下有人被自己抛下的猪骨头砸伤。5月10日，江某被公安机关抓获。7月20日，该案被移送深圳前海蛇口自贸区检察院（下称“前海检察院”）审查起诉。
检察机关经审查认为，江某抛掷猪骨头的中午时段属于人流活跃时间段，事发地处于人流量较大的地铁口附近路段，周边商铺林立，人行道人员往来密集。江某在人员密集区域高空抛掷重物，客观上造成行人轻微伤的损害后果，其行为危害性较大，已构成高空抛物罪。
8月3日，前海检察院依法对江某提起公诉。8月10日，法院以高空抛物罪判处江某有期徒刑六个月，并处罚金5000元。目前判决已生效。
Jiang was arrested on May 10. Prosecutors later concluded that throwing a heavy object from a height in a densely populated area had caused minor injury to a pedestrian and posed a serious public safety risk, constituting the offense of throwing objects from high-rise buildings. The verdict is now final.
