“人间烟火味,最抚凡人心”这句本意是传递生活温情的话语最近竟然出现在香烟宣传中。
A phrase originally meant to convey everyday warmth — "the smell of everyday life soothes the ordinary heart" — has recently appeared in an unexpected place: a cigarette advertisement.
近日,有网友发文称,北京市某家7-ELEVEN便利店,悬挂了“人间烟火味最抚凡人心”的香烟广告。
According to online posts, a 7-Eleven convenience store in Beijing displayed a promotional sign using the phrase to advertise cigarette sales.
据网友发布的照片,该店门口放置着一块宣传牌,上面写有“7-ELEVEN便利店,人间烟火味,最抚凡人心。从即日起开始售卖香烟”等字样。
Photos shared by netizens show a sign placed at the store entrance reading, "7-Eleven convenience store. The smell of everyday life soothes the ordinary heart. Cigarettes on sale from today."
据现代快报12月18日报道,涉事便利店的工作人员表示,广告牌是店里自己做的,后来也发现广告牌内容不妥。
According to reports, staff at the store later acknowledged that the sign was made by the store itself and that its wording was inappropriate.
另据经视直播报道,12月20日,门店所属的柒一拾壹(北京)有限公司工作人员称,公司对此事高度重视,在发现涉事门店张贴不当广告后,已要求店铺第一时间撤下。至于店铺为何张贴此类广告,工作人员表示不知情。
Further reports said that on Dec 20, the company operating 7-Eleven stores in Beijing said it took the issue seriously and ordered the immediate removal of the improper advertisement.
此事引发网友广泛热议。有不少网友认为,用“烟火味”作为香烟售卖的广告标语,让人感觉不适,不应用这样的温情词汇来宣传香烟。还有部分网友认为,这只是广告的创意表达。
The incident quickly sparked widespread discussion online. Many netizens argued that using a phrase associated with warmth and daily life to promote cigarettes was uncomfortable and inappropriate, especially given the health risks of smoking. Others, however, viewed it as a form of creative advertising rather than a deliberate violation.
对于此事,湖北炽升律师事务所律师杨敏指出,门店此举实属不妥。
国家明令禁止户外烟草广告及向未成年人推销香烟的行为,该广告未区分受众,涉嫌违法发布烟草广告。该广告还将“人间烟火味”与售卖香烟相关联,构成变相烟草宣传,也违反广告法相关规定。
Chinese regulations explicitly prohibit outdoor tobacco advertising and the promotion of cigarettes to minors.
The advertisement did not distinguish its audience and was displayed in a public space, raising concerns about unlawful tobacco promotion.
In addition, by linking the phrase "the smell of everyday life" with cigarette sales, the sign could be considered indirect tobacco advertising, which also violates advertising regulations.
依据《中华人民共和国广告法》第二十二条规定:禁止在大众传播媒介或者公共场所、公共交通工具、户外发布烟草广告;禁止向未成年人发送任何形式的烟草广告;禁止利用其他商品或者服务的广告、公益广告,宣传烟草制品名称、商标、包装、装潢以及类似内容。
