5月13日,@小米法务部 发文称,关于公司诉聚好看科技股份有限公司商业诋毁一案,特此作如下声明:

2023年8月31日,法院做出一审判决,法院认为:聚好看公司通过其微博账号“Vidda官方微博”发布侮辱、贬损小米公司的虚假信息和误导性信息,损害了小米公司的商业信誉和商品声誉,构成商业诋毁。

法院判令:聚好看公司在“Vidda官方微博”账号置顶位置,连续七日刊登声明,消除影响,另赔偿小米公司经济损失及合理开支共计55万元。

近日,小米收到法院终审判决,驳回聚好看公司的上诉,维持原判。二审法院认为:从语义、语境、特定主体对应性分析,再结合公众认知,一审法院认定聚好看公司发布的微博内容指向小米结论正确;聚好看公司将小米公司视为竞争对手,将与小米公司类似的“年轻人第一台好电视”、“我们的征途是真正的星途大海”作为宣传口号,在此背景下,通过标注拼音试图掩盖指向性,主观存在恶意,且在双十一节点发布,进一步证明其通过诋毁竞品提升自身销量的意图。

Xiaomi's legal department announced on Tuesday that the company has prevailed in a final judgment against Juhaokan Technology Co Ltd for commercial defamation. The ruling upholds an earlier judgment, requiring Juhaokan to issue a public apology and pay damages of 550,000 yuan.

According to Xiaomi's statement, in a first-instance ruling issued on August 31, 2023, the court determined that Juhaokan, through its Weibo account Vidda Official Weibo, had posted false and misleading information that insulted and disparaged Xiaomi, harming its commercial reputation and brand image. The court concluded that these actions constituted commercial defamation.

The initial judgment required Juhaokan to publish a public apology that would be pinned to the top of its Weibo account for seven consecutive days as well as compensate Xiaomi 550,000 yuan for economic losses and reasonable expenses.

Following Juhaokan's appeal, the second-instance court recently upheld the original verdict.

In its final ruling, the appellate court emphasized that Juhaokan's posts were intentionally designed to malign Xiaomi while promoting its own products.
